VIEW GARAGE SALE APPLICATION

 

The Garage Sale Permit Application can be obtained here. Residents may also pick up a Garage Sale Application from the Municipal Clerk’s Office. The Municipal Clerk’s Office is open Monday through Friday from 8:30AM-4:30PM.

 

Garage sales shall be conducted, exclusively, between the hours of 9 A.M. and 7 P.M.

 

The advertisement of garage sales shall be regulated as follows:

 

o   Only one (1) on premise outdoor sign shall be permitted.

 

o   Such sign shall not exceed three (3) square feet in size.

 

o   Such sign shall be displayed only on the dates and during the hours of sale.

 

o   Only (2) off-premises signs may be posted on a municipal right of way and not private property. Said sign shall be freestanding and not exceed 3 square feet in area, and shall be removed within 24 hours after the sale has been concluded.

 

o   The name and address of the licensee shall be posted on this sign.

 

o   No signs shall be permitted to be posted on such structures as telephone poles, street signs, trees or fences.

The Borough of Fairview has a total number of 25 licenses, which consist of the following:

 

·         3 Licenses are Number 31 Licenses, a Club License that entitles the licensee to sell alcoholic beverages only for immediate consumption on the licensed premises and only to bona fide club members and their guests.

·         1 License is a Number 32 which is a Plenary Retail Consumption License with Broad Package Privilege.

·         13 Licenses are Number 33 Licenses, which is a Plenary Retail Consumption Liquor License. This retail consumption license entitles the licensee to sell alcoholic beverages for consumption on the licensed premises and also to sell in original containers for consumption off the premises.

·         8 Licenses are Number 44 Licenses, which is a Plenary Retail Distribution License and entitles the licensee to only sell alcoholic beverages in original containers for the consumption off the licenses premises.

 

When viewing the Liquor License List, please note that all efforts have made to accurately reflect the correct information. However, data could be different than what is on the list. The list will be updated based on changes in license information or at a minimum every three months. COVID-19 Expansion Permits

Licensees that have on-premises retail consumption privileges may apply to The NJ Division of Alcoholic Beverage Control for a COVID-19 Expansion Permit to allow the licensee to temporarily expand its licensed premises to include adjacent and contiguous outdoor areas, and also non-contiguous outdoor areas that are within reasonable proximity of the licensed premises.

Application for, and issuance of, the COVID-19 Expansion Permit, will be through POSSE. The fee is $75.00. The duration of the Permit will run from its date of issuance through November 30, 2020. If the outdoor expansion area is public property (such as a sidewalk) the licensee must have the written approval of the Township.

The Borough of Fairview offers free notary services for Fairview residents.  Please be sure to bring proof of identification with you.  Please do not sign anything unless in the presence of the Notary.  If more than one signature is needed on the document, all parties must be present and identification produced before a Notary signature and seal are placed on the document.

How to Become a Notary Public

The Notary Public serves as an impartial witness to the signing of documents, attests to the signature on the document, and may also administer oaths and affirmations. The State Treasurer appoints a notary public for a five-year period and may renew the appointment for five-year increments. Candidates, who must be New Jersey residents and are at least 18 years of age, are sworn into office by the clerk of the county in which the candidate resides. New Jersey

Notaries are commissioned by the State Treasurer for a period of five years. Notaries must also be sworn in by the clerk of the county in which they reside. A person can become a notary in the state of New Jersey if they: (1) are over the age of 18; (2) are a resident of New Jersey OR is regularly employed in New Jersey and lives in an adjoining state; (3) have never been convicted of a crime under the laws of any state or the United States, for an offense involving dishonesty, or a crime of the first or second degree, unless the person has met the requirements of the Rehabilitated Convicted Offenders Act (NJSA 2A:168 -1) Notary applications must be endorsed by a state legislator.

 

Notaries in the state of New Jersey serve as impartial witnesses to the signing of documents, attests to the signature on the document, and may also administer oaths and affirmations. Seals are not required; many people prefer them and as a result, most notaries have seals in addition to stamps. Notaries may administer oaths and affirmations to public officials and officers of various organizations. They may also administer oaths and affirmations in order to execute affidavits/verifications, and to swear in witnesses.

Notaries are prohibited from predating actions; lending notary equipment to someone else (stamps, seals, journals, etc.); preparing legal documents or giving legal advice; appearing as a representative of another person in a legal proceeding. Notaries should also refrain from notarizing documents in which they have a personal interest.

Common Law

A public record under common law is one required to be kept, or necessary to be kept in discharge of a duty imposed by law, or directed by law to serve as a memorial and evidence of something written, said, or done, or a writing filed in a public office. The elements essential to constitute a public record are that it be a written memorial, that it be made by a public officer, and that the officer be authorized by law to make it.

If the information requested is a "public record" under common law and the requester has a legally recognized interest in the subject matter contained in the material, then the material must be disclosed if the individual's right of access outweighs the State's interest in preventing disclosure.

Note that any challenge to a denial of a request for records under common law cannot be made to the Government Records Council, as the Government Records Council only has jurisdiction to adjudicate challenges to denials of OPRA requests. A challenge to the denial of access under common law can be made by filing an action in Superior Court.

·         $0.05 per page for letter sized pages and smaller

·         $0.07 per page for legal sized pages and larger

·         For delivery, all fees will be based upon the type of delivery requested and the fee will be added to page costs.

·         Extraordinary service fees are dependent upon the request (i.e. computer disc, CD-ROM, DVD).

·         Payment may be in the form of cash, check or money order.
